Terms & conditions
Draft pending qualified New Zealand and Australian legal review. Not legal advice or a guarantee of compliance.
Buyer 30-day inspection period and return
For eligible transactions covered by the escrow agreement, buyers have a 30-day inspection period beginning on the date stated in the transaction agreement. If the buyer validly elects to return the vehicle under the agreement and follows the documented return procedure, the full purchase amount held is refunded with no refund fee charged to the buyer; the seller is responsible for the agreed return-related costs. Funds are held by Halfmoon Bay Motors in its own business account — this is not an independent or regulated escrow service. See the Escrow Protection page for the full process.
Commission
Consignment commission is paid exclusively by the seller. Buyers never pay commission.
Company and scope
Halfmoon Bay Motors, 15 Ayr Street, Stewart Island, Halfmoon Bay / Oban 9818, New Zealand. Services include vehicle enquiries, consignment submissions and transport quote requests. Confirmed company identity, operating jurisdictions and applicable service terms must be supplied before adoption.
Website and listing information
Sample listings are not verified inventory. Vehicle descriptions, ownership, history, inspection findings, defects and warranties must be verified before reliance. Each listing identifies company ownership or consignment agency; statutory obligations cannot be avoided by a generic disclaimer.
Seller consignment authority
A valid signed agreement must identify the owner and authority to sell, vehicle, asking/minimum prices, offer approval requirements, commission and fees, storage, insurance, custody, test drives, outstanding finance, deductions, proceeds, term, termination, handover documents and unsold-vehicle arrangements.
Remote owners may authorize agreed activities, but form submission is not authority. Sales may not exceed the signed scope, transfer ownership automatically, or override mandatory motor-trader, consumer or registration law.
Buyer terms
Confirm listing type, known defects, inspection opportunities, currency, fees, deposits, due dates, collection/delivery, registration and ownership transfer before commitment. Cancellation, refunds, warranties and complaints must respect mandatory rights. Purchase and reservation requests require acceptance and do not themselves finalize a sale.
Shipping
Accepted quotes must document validity, inclusions, transit estimates, pickup/delivery duties, access, condition, contents, delays, claims, insurance and exclusions. International taxes, duties, quarantine, permits and port charges are separate unless confirmed. Cancellation and rescheduling conditions must be agreed.
Payments and fraud prevention
Bank transfer / wire transfer and PayID where supported are the accepted methods. Our payment department is based in Australia, and the designated bank account details provided for eligible transactions are Australian bank account details; international transfer fees and currency conversion may apply. Verify instructions independently. Cleared funds require authorized verification; a receipt is not enough. Deposits, payment deadlines, refunds and deductions must be specified before commitment.
Privacy
Private contact details, identification, vehicle records, signed documents and payment evidence are used only for agreed services and restricted to authorized access. See the separate draft privacy policy.
Law and disputes
Applicable law, complaint contacts and jurisdiction-specific dispute resolution must be finalized by a qualified professional. Nothing in this draft is intended to remove mandatory consumer rights.
